Why hasn't Fowle been kicked out as a GM yet? I mean, seriously. He's been shown to be petty and willing to drop monsters well beyond the party's level on other GM's parties, yet at the same time lacks the tactical sense to properly utilize those monsters, bend/ignore rules to suit his whims (the lightning elemental), and can't even make good puzzles to make up for it. I mean, jeez! About the only reason you'd want him as a GM is if you've been looking forwards to getting your teeth kicked in by CR8 monsters while you're only level 2. I mean, maybe if he rewarded strategy and outside-of-the-box thinking, but he shut down the lightning elemental and couldn't employ hit and run with the waiths. Maybe he's a good story-teller, but he seems entirely focused on just killing players and probably can't tell a decent story considering how weak that puzzle was. I would not want him as my GM under any circumstances.

Well, technically CR 8 is still in "Overpowering" territory rather than "Impossible", at least as far as the 3.5 encounter calc is concerned (if the other party joins up, it's considered "Very Hard"). That is, assuming the party is actually level 2. However, I assume they are at least level 3, because the cleric cast Cure Moderate Wounds, a spell-level 2 cleric spell. Granted, that doesn't change the difficulty level, but again, that's minimum. I'd even go so far as to say they are level 4 (because the knight mentions MULTIPLE healing spells having been employed against it), but that's speculation. It would bump the difficulty for the initial party down to "very difficult" though.

The monster they are fighting is a colossal undead, right? About the only monster that I can think off that would be colossal, undead and not impossible for a Level 2 party to beat would be a Dread Linnorm Skeleton (which is, well... CR 8).

I don't think GM's can be kicked out here, they pretty much control reality and the best a PC or NPC can hope for is some other GM taking over for them if they don't like the one seemingly arbitrarily assigned to them.

You can always 'kick someone out'. In this case by probably forbidding him to take new players or run dungeon groups. My best guess is that he probably has some political sway within the community that keeps them from opposing him.
